An off-duty federal immigration officer was hospitalized and taken into custody early Friday after allegedly assaulting an elderly homeowner and his daughter in central Fresno, California, police said.
The confrontation occurred shortly after 3 a.m. near East Dudley Avenue and North Broadway Street, according to the Fresno Police Department. Authorities said a woman returned home and discovered a man sleeping on her front yard. She informed her 72-year-old father, who stepped outside to ask the stranger to leave the property.
Confrontation on the front lawn
Investigators said the man on the lawn, identified by authorities as 32-year-old David Gonzalez of Texas, appeared drunk and agitated upon waking up. Gonzalez then physically assaulted the older man, forcing him to the ground and inflicting visible injuries, according to KMPH Fox 26.
When the homeowner’s daughter attempted to step in to protect her father, Gonzalez physically attacked her as well, causing her to fall to the ground, police said. Fearing for their physical safety, the 72-year-old man retrieved a firearm and discharged a single round into Gonzalez’s midsection, ABC News reported.
Following the gunfire, the daughter reached out to her boyfriend, an off-duty law enforcement officer, who quickly came to the residence and placed Gonzalez in handcuffs before patrol units arrived, according to local police reports. Fresno officers responding to a ShotSpotter alert and several emergency calls discovered Gonzalez restrained and suffering from a gunshot wound.
Paramedics transported Gonzalez to a regional medical facility, where ABC30 Fresno reported he was listed in serious condition. Police stated that Gonzalez is facing felony assault charges while remaining in custody at the hospital.
Self-defense determination and community response
The Fresno Police Department confirmed that the 72-year-old resident legally possessed the firearm and will not face criminal charges because investigators determined he acted out of fear for his own life and his daughter’s life. Authorities have not released the names of the father and daughter, noting that medical personnel were still assessing their injuries.
Detectives confirmed that Gonzalez is an agent with U.S. Immigration and Customs Enforcement who was off duty and alone when the confrontation occurred, according to police statements cited by ABC News. Detectives said it remains unclear why Gonzalez was present in the neighborhood.
The incident quickly drew attention from municipal leaders. Fresno City Councilmember Miguel Arias told ABC30 Fresno that out-of-state federal agents have been utilizing nearby facilities for operations and suggested that Gonzalez had likely been drinking at nearby venues beforehand. Another local official, Fresno City Councilmember Mike Karbassi, urged the federal agency to halt Central Valley activities, saying, “Enough is enough. We’ve endured days of fear-stricken enforcement that has now tilted into full-bore violence,” ABC30 Fresno reported.
Federal representatives for the Department of Homeland Security did not immediately respond to requests for comment from ABC News. Fresno police said the investigation remains ongoing, and detectives are urging anyone with neighborhood security footage or witness accounts to contact authorities.
